Citizens who leave Kazakhstan for permanent residence abroad will not lose their pension payments. This clarification was provided by the Constitutional Court.

The Court reviewed the provisions of the Social Code regarding pension payments to citizens who relocate abroad. The review of the case was prompted by an official submission from one of the judicial bodies, which questioned the constitutionality of legal requirements that restrict pension payments solely to the fact of residence within the territory of Kazakhstan.

According to the Constitutional Court, a citizen's relocation abroad does not nullify their constitutional rights and social guarantees. This means that the right to receive a pension is preserved.

Furthermore, the Court noted that the suspension of payments can only apply to specific categories explicitly indicated in the law.

In this regard, the Government has been recommended to introduce relevant amendments to the Social Code within one year.
